Advertising Terms

1       Introduction
This Website is operated by The Australian Wine Community (ABN 13 685 767 106) ("We", "Us").

These Advertising Terms of use apply to the submission by users use of this Website, of advertising content and materials on this Website. 

In submitting an advertisement for publication on this Website, you agree to be bound by these Advertising Terms.  If you do not agree, you must not use place any advertising or promotional material on this Website.  These Advertising Terms form a part of and must be read in conjunction with any other applicable terms and conditions (including our Website Terms of Use  and our as to Privacy governing the use of this Website.

2       Terminology
In these Terms:

  • the terms "we", "us" and "our" are a reference to the Australian Wine Community ABN13 685 767 106;
  • the terms "you" or "your" are a reference to a person placing an advertisement on this website;
  • the term "advertisement" includes any material or content that is intended to or has the effect of advertising or promoting any business, product or service. This includes (but is not limited to): a basic business listing, a premium business listing, a basic event listing, a premium event listing, a notification or a posting containing a promotional offer, a written article or editorial, a price listing, a link to a third party website, or banner or other advertising, and
  • the term "member" is a reference to a person who is registered to participate in any of the discussion forums hosted on this Website as a contributor.

3       Amendments to Terms
We reserve the right to amend these Advertising Terms from time to time.  Amendments will be effective immediately upon their being posted on this page on this Website, and will apply to any advertisements posted by you on this Website after the change.  Although we will endeavour to notify members of changes to these Advertising Terms, it is your responsibility to regularly check this page for any changes.  Your submission of an advertisement of the Website will amount to an agreement by you to be bound by the Terms as amended from time to time.

4       Fees and Charges
Some, but not all, advertisements are chargeable.   Our fee structure can be found on our advertise page.  When you place an advertisement on the Website, you will be advised about what fees you are liable for and when these are required to be paid.   

Where fees are payable for placing any advertisement on the website, you will be required to pay the fees to us in advance, at the time you first place your advertisement or you first establish your premium listing. 

Where the fee relates to the publication of the advertisement for a given period, we will try to notify you (by an e-mail to your registered e-mail address) before the expiry of that period.  If you wish to resubmit the advertisement, further fees may be payable.  Similarly where the period of your premium listing is about to expire, we will try and notify you in advance.  If you do not renew your premium listing, we may remove it, or reduce it to a basic listing. 

We will invoice you for all chargeable advertisements.  These will be sent by e-mail to your registered e-mail address.  Our fees do include any applicable GST.

If cleared payment is not received or is subsequently reversed or dishonoured, we may debit your registered credit card or bank account again. If your transaction fails, you may incur late payment fees, as well as any debit collection fees incurred.  We may also suspend or remove your advertisement (although this will not limit our right for payment). 

Fees are not refundable if your advertisement is cancelled, removed, withdrawn or altered for any reason. 

5       We may alter advertisements
We may remove (whether temporarily or permanently) or alter any advertisement you submit or post to the Website if:

  • we consider the advertisement (or any part of it) to be inappropriate, offensive, misleading or deceptive, defamatory, incorrect or in any other way in breach of these Advertising Terms or the Website Terms, or any law or third party right; or
  • we are instructed to do so by any third party; or
  • we are notified of a dispute relating to the advertisement or any part of its content.

We may also select, edit, condense, decide the duration of, change the nominated "category" of, withdraw or refuse any advertisement.

We will try to tell you if we remove or alter any material you provide us.

6       Rules and Guidelines - Advertisement layout
We may set rules and guidelines for the layout and format of advertisements from time to time, and you agree to comply with them.  Without limiting those rules and guidelines, advertisements must not:contain any of the following:

  • certain types of HTML;
  • any scripting (e.g. JavaScript, Flash, XML, CGI etc.);
  • executable files or active content;
  • Video, sound or animations
  • links to downloadable files;
  • links to any website or content that is or contains material which is inappropriate, offensive, misleading or deceptive, defamatory, incorrect or in any way in breach of any law or third party right
  • be placed in any part of the Website, other than as designated by us.
